WAIVER OF LIABILITY, PERMISSION FORM AND CONSENT TO MEDICAL TREATMENT

Consent*

In consideration of my or my child or ward’s participation in all softball practice, instruction, evaluation, travel, games or any other related activities afforded me or my child or ward by Fusion Fastpitch LLC d.b.a. Fusion or any of the Released Parties (as defined below) in which I participate and freely give permission to do so (collectively, the "Activities"), wherever the Activities may occur, I agree to assume all risks incidental to such participation (which risks may include, among other things, muscle injuries, broken bones or other personal injuries). On my own and/or my child or ward’s behalf, and on behalf of my and/or my child or ward’s heirs, executors, administrators and next of kin, I hereby release, covenant not to sue, and forever discharge the Released Parties (as defined below) of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with my or my child or ward’s participation in the Activities, and further agree to indemnify and hold each of the Released Parties harmless from and against any and all such liabilities, claims, actions, damages, costs or expenses including, but not limited to, all reasonable attorneys' fees and disbursements. I understand that this release and indemnity includes any claims based on the negligence, action or inaction of any of the Released Parties and covers, among other things, bodily and mental injury, property damage, and loss by theft or otherwise, whether suffered by me or my child or ward either before, during or after such participation. I declare that I and (if participating) my child or ward have had a physical and are physically fit, in good health and have the skill level required to participate in the Activities and assume all responsibility for same. I further authorize medical treatment for me and/or my child or ward, at my cost, if the need arises and that the Released Parties are hereby given consent to obtain any such treatment they deem necessary within their judgment including transport to a hospital for emergency medical or surgical treatment. For the purposes hereof, the "Released Parties" are: Fusion Fastpitch LLC d.b.a. Fusion, its agents, Independent Contractors, Members, Managers, Officers, employees, volunteers, coaches or anyone affiliated with same, and specifically including Travis Unruh and Cammie Unruh. This Waiver and Permission Form shall be governed by the laws of the State of Indiana and any legal action relating to or arising out of this Waiver and Permission Form shall be commenced exclusively in the state courts of Floyd County, Indiana. I certify I am 18 years of age or older, have fully read and understand the contents of this Waiver of Liability, Permission Form and Consent to Medical Treatment and enter into same freely. If I am executing this Waiver and Permission Form on behalf of my child or ward, the information set forth below pertaining to my child or ward is true and complete and I give my permission for his/her participation in the Activities.

COACHING AGREEMENT

This agreement is entered into between Fusion Fastpitch, LLC (dba Fusion) and you, the Coach. As coaches, we truly want what is best for each team member and we ultimately want your athlete to have a positive experience. As Head Coach of an individual team, you have and agree to the following responsibilities:

Team Administration

Each team must maintain a team binder that includes information for the team, its coaches and players. This information includes: o Team Roster o Player Birth Certificates o Sanction Information for each sanctioning body the team is registered with. This includes copies of any online roster required by the sanctioning body. • Head Coaches are responsible for ensuring that assistant coaches meet the integrity and practices of the Fusion program. • Head Coaches are responsible for the safety and welfare of each player. • Head Coaches are responsible for the scheduling of all tournaments and practices. • Head Coach should maintain a win-loss record for the team that will be reported to Marley Schmidt at [email protected] or via Coach GroupMe after each event.

Team Finance/Fundraising

Head Coaches are responsible for setting up a team bank account. This account should be separate from any personal bank accounts and only team related revenue and expenses should be run through the team bank account. No commingling of funds or use of the team bank account for anything other than team use will be tolerated. • Head Coaches will establish a budget for the team at the beginning of the season that will cover all tournament costs, sanction fees, Team Fees and other miscellaneous items. • Once budget is established, Head Coach is responsible for communicating to all players their required fees as well as establishing and communicating the necessary timing of when fees are due. The Coach should make sure all fees are paid timely and are responsible for contacting families for payment. • Fundraising to help offset player fees is permitted, but remember that any fundraisers are representations of the Fusion program and should be administered as such. • Head Coach is responsible for paying for all tournaments and any other costs the team incurs. All bills should be paid timely and the team should not incur obligations for which there are no funds. • Head Coach should report financial activity for the team (including cash balance) to the IFE Board if requested. • As it relates to the team bank account and handling of team and player funds, the Head Coach assumes the position of fiduciary and financial steward, which creates a position of trust, which cannot be violated. Any breach of this trust or question of impropriety will not be tolerated. • I agree to indemnify, defend and hold Fusion Fastpitch, LLC (dba Fusion) as well as Travis and Cammie Unruh harmless from any claim, action or demand related to my acts, omissions or conduct or any violation of this Agreement, including all costs and attorney fees related to same.

Coach Conduct

Coaches are expected to have a positive attitude, support their team, and show respect for the team, parents, umpires, tournament directors and tournament/practice locations. • Head Coaches are responsible for enforcing sportsmanlike conduct for the team, including but not limited to Other Coaches, Players, Parents, and Fans. • Players will be selected based on skill level, understanding of their specific role on the team, effort, knowledge of the game, and attitude. • Playing time will be determined by players’ ability, skills, work ethic, attitude, and ability to fit into your teams program. Any discussions of playing time or a player’s role on the team should be discussed directly with the player before discussing with parent. • Head Coaches are expected to provide periodic feedback to players regarding their attitude, effort and performance as well as areas in need of improvement. • Game strategy and decision-making is the sole discretion of the coaches. It is based on knowledge of the game and evaluation of the player at practice and performance during games. • Head Coaches must understand that they represent themselves, their team, and Fusion at all times. • Players must be current on payment for any and all fees (including but not limited to player fees, uniforms, fan wear) assessed by their team in order to participate in practices and tournaments.

Uniforms/Fanwear

Uniforms and fanwear must be ordered through the approved vendor or as otherwise directed by Travis and Cammie Unruh. • For the orders, Coaches will place the orders directly and get reimbursement from players. When placing the uniform orders, please consider any spares needed for subs. • In the event there is a problem with the items ordered, the Head Coach will contact the vendor directly to reconcile the issue.

Background Check-HEAD COACHES ONLY

Background checks are required for all Head Coaches per the Fusion insurance policy. You will receive an email to complete your background check.
